Portions of a lawsuit regarding a dispute
over funds from Boulder’s 1940s WWII Ball have been dismissed.
All claims directly relating to the ball
and the ball’s nonprofit organization were dismissed on Aug. 22 by Judge Ingrid
Bakke, according to court filings from Boulder County District Court. The judge
ruled that the plaintiff, a nonprofit board for the ball, failed to present an
attorney to represent the case by the Aug. 5 deadline.
Three people claiming to be board members
of the nonprofit for the ball — Chris Dailey, Bob Dudley and Wanda Plimmer — filed
a lawsuit against Khyentse James, the creator and founder of the ball, last
January. James claimed that the allegations were false and that the board did
not exist.
According to the filings, the plaintiffs’
initial attorney left the case in April, and the plaintiffs were advised by the
court to find a substitute counsel by Aug. 5.
“Due to the fact that there are still
ongoing legal issues yet to be resolved regarding this matter, it would be
quite inappropriate for anyone at 1940s WWII Ball to comment,” Dudley told
Boulder Weekly.
Dailey, who serves as executive director
of Boulder Creek Events, did not respond to a request for comment.
